Protecting your data matters to us. This policy describes how PropertyAI (operated by propertyphotos.at, Lukas Merle & Patrick Pedronetto) processes personal data under the GDPR.
1. Controller

2. Data processed
Account data (name, email via Google sign-in), uploaded assets (photos/videos), project data incl. address and GPS coordinates, and usage/billing data (credits, Stripe payments).
3. Purposes & legal bases
Processing is carried out to perform the contract (Art. 6(1)(b) GDPR), based on our legitimate interest in securely operating the platform (lit. f), and, where required, on your consent (lit. a).
4. Processors & third countries
We use carefully selected providers: Google Cloud / Neon (hosting & database, EU Frankfurt region), fal.ai and Higgsfield (AI generation), Stripe (payments), Resend (email), and Google (sign-in, Maps/Street View). This may involve transfers to the USA, based on EU Standard Contractual Clauses.
5. Retention
Data is stored for as long as your account or project exists, plus any statutory retention periods. Uploaded and generated assets can be deleted at any time.
6. Your rights
You have the right to access, rectification, erasure, restriction, data portability and objection. You may lodge a complaint with the Austrian Data Protection Authority (dsb.gv.at). No automated decision-making with legal effect takes place. This text is a draft and is not legal advice.
7. AI-generated content (EU AI Act)
PropertyAI edits and generates images, videos and texts using artificial intelligence (e.g. virtual staging, sky replacement, video effects, exposé texts). In line with the transparency obligations of the EU AI Act (Regulation (EU) 2024/1689, in particular Art. 50), we point out that such results are AI-generated or AI-edited. On request, a visible AI label can be embedded into the exported media. Responsibility for the lawful use of altered property depictions (e.g. no misleading representation of the actual state of a property) lies with the respective agent/user.
